As currently drafted the Charity Commission have absolute discretion to decide whom to consult. It must surely be important that the sector itself should be involved with the development of the guidance which the Charity Commission is to produce on the subject of public benefit. It is unlikely that the Charity Commission would issue guidance without having first consulted the relevant part of the charitable sector but it would be helpful if this were mandatory under statute.
