This amendment is to ensure that the power to modify the powers of an unincorporated charity cannot be exercised with retrospective effect. It would be undesirable for charity trustees to be able to act ultra vires and then to put matters right retrospectively as this would certainly not provide the requisite certainty for those dealing with the charity.
